Home Inspection and Earnest Money Deposit

The Earnest Money Deposit (EMD) and Inspection Period is a crucial part of the home buying process when buying a home in the Richmond, Virginia area. The EMD is an agreed upon dollar amount that is put up by the buyer to show the seller that there overall interest in the property, which is expressed through a monetary format. The EMD is typically 1% – 2.5% of the homes purchase price. The inspection provides the potential home buyer the opportunity to thoroughly inspect the property and ensure that it meets their expectations and requirements before finalizing the purchase.

Typically, the Inspection Period lasts between 7 to 14 days and starts after the contract has been signed and the EMD has been submitted. During this time, the buyer can conduct various inspections, including a home inspection, a termite inspection (generally performed by the Seller), a radon inspection, and any other inspection they deem necessary.

If the inspections reveal any significant issues with the property that the buyer is not satisfied with, they can either renegotiate the terms of the sale or choose to back out of the deal and have their EMD returned to them. Generally, the negotiations that take place are the potential home buyer asking for items to be repaired that were identified during the inspection process or requesting/negotiating credits from the Seller that can be applied to the potential Home Buyers closing cost, loan fees, interest rate buy down, etc. However, if the buyer decides to proceed with the purchase despite the inspection results, the EMD becomes non-refundable and is applied towards the down payment of the home.
